WHAT IF THE COURT CHOOSES THE CUSTODY EVALUATOR?

Sometimes the custody evaluator is selected by the judge. The reason for this happening is often because the two sides are unable to agree on a custody evaluator or this is the way the judge operates. When this happens, the client is somewhat limited for obvious reasons. However, regardless of who selects the custody evaluator, the same type of preparation and protocol as previously described still applies. An informed client and attorney can ensure that the proper procedures are followed during a custody evaluation - no matter what the circumstances may be. If proper procedures are not followed, then there may grounds to challenge the custody evaluation.
